Smith Villazor LLP Moves to Dismiss CFTC Complaint Against BitMex Co-Owner Ben Delo

On September 20, 2021, Smith Villazor LLP filed a motion to dismiss a Commodity Future Trading Commission (CFTC) complaint against BitMEX co-owner Ben Delo pending in the U.S. District Court for the Southern District of New York.  As set forth in Law 360, a Delo spokesperson stated that “[t]he CFTC’s case against Mr. Delo is deeply-flawed in numerous ways, including that the CFTC has not established that U.S. courts have any jurisdiction over Ben, a British citizen who had no connections—business or personal—with the United States”.  A copy of the memorandum of law can be found here.
