Clark Smith Villazor LLP, on behalf of its service-disabled veteran clients, obtained an extension of a TRO previously issued by a NY state judge halting the processing of allegedly unconstitutional conditional adult use retail dispensary (CAURD) licenses in the cannabis industry. On August 3, 2023, the firm filed a lawsuit against the New York Office of Cannabis Management alleging that the agency’s rules that prioritize applicants with prior drug convictions for CAURD licenses are unconstitutional and violate the NY Marijuana Regulation and Taxation Act (MRTA) to the detriment of other social and economic equity applicants prioritized by the Legislature in the MRTA.
