On September 28, 2023, Clark Smith Villazor LLP filed a motion to suppress evidence seized pursuant to search warrants issued against Amit Dagar, the defendant in a criminal case pending in the U.S. District Court for the Southern District of New York. The motion argues that the warrants were obtained based on false and misleading statements in the warrant applications and that the Court should suppress the evidence obtained or, alternatively, order a hearing under Franks v. Delaware to assess the misstatements and omissions in the warrant applications. A copy of the memorandum of law in support of the motion can be found here.
