On January 11, 2024, Chris Clark and Benjamin Dozier, on behalf of client VR Capital, filed an opposition to PDVSA’s motion to dismiss in VR Global Partners LP v. Petroleos de Venezuela SA et al., 23-cv-05604 pending in the U.S. District Court for the Southern District of New York. The Clark Smith Villazor LLP team argues that the defendants are “wrongly trying to insulate itself from liability in the litigation by blaming the administration of Venezuelan President Nicolas Maduro. See Law360, “Asset Manager Says PDVSA Can’t Escape Suit,” (Jan. 11, 2024) (subscription required). As set forth fully in the brief, the CSV team contends that the “court should reject defendants’ attempt to avoid liability for an unlawful and coordinated fraudulent scheme by blaming the change in administration.”
